NOTICE OF THE PASSING

OF A ZONING BY-LAW (CANNABIS CULTIVATION)

 

TAKE NOTICE that the Council of the Township of Montague passed By-law No. 3721-2019 on the 4th day of June, 2019, under Section 34 of the Planning Act, RSO 1990, as amended.

 

THE PURPOSE of the of the Zoning By-law Zoning By-law Amendment is to establish specific zoning provisions for cannabis cultivation facilities.  The proposed amendments establish the appropriate definitions and propose sensitive use setbacks and other regulatory stipulations relating to cannabis cultivation facilities in certain rural, agricultural and industrial zones.  The new provisions create differential setbacks for cannabis grown indoors and outdoors.

TAKE NOTICE that any appeal to the Local Planning Appeal Tribunal in respect of the Zoning By-law Amendment must be filed with the Clerk of the Township of Montague not later than the 2nd day of July, 2019.  A notice of appeal must set out the reasons for the appeal, and the specific part of the proposed Zoning By-law Amendment to which the appeal applies.  A notice of appeal must be accompanied by the fee required by the Tribunal.

 

TAKE NOTICE that only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

 

TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

 

EFFECT OF WRITTEN AND ORAL SUBMISSIONS: Council considered oral and written feedback from members of the public and from industry proponents.  Based on feedback received, Council directed several changes to the draft policy, including reduced setback requirements, clarified definitions and visual screening provisions.
